Various proponents of animal rights—for example, H. J. McCloskey— maintain that while brute animals cannot have; moral rights they can have legal rights. Indeed, McCloskey himself goes so far as to maintain that even inanimate objects are able to have legal rights.1 And why should not inanimate objects be able to? After f all, for there to be a legal right is anything more required than that whatever agency is empowered to issue legal rights simply legislate or proclaim that so-and-so (...) has that legal right? This Festschrift in Professor Kristeller’s honor consists of contributions by scholars who have had some connection with Columbia University, his "intellectual home in the United States for three decades." It also includes a Tabula Gratulatoria listing many other friends from the United States and Europe. The editor’s opening essay provides an interesting and informative account of this scholar’s academic career, and should be read together with the complete annotated bibliography of his publications through 1974. The latter lists 149 "major publications" (...) and 220 "minor publications." Kristeller’s contributions to the history of Renaissance philosophy are well known to historians of philosophy, and deservedly so. Here reference should be made to his groundbreaking studies on Marsilio Ficino and Pomponazzi, and on others such as Pico della Mirandola and Petrarch, as well as on Renaissance Platonism, Aristotelianism in the Renaissance, Thomism in the Renaissance, Paduan Averroism, and Alexandrism. But he has also contributed greatly to the fields of medieval and Renaissance history, and especially to our understanding of Renaissance humanism, Renaissance music, and Renaissance art. He is universally recognized as one of the world’s foremost authorities on manuscript research, as is witnessed, for example, by the cooperative project, Catalogus Translationum et Commentariorum, which he founded, and by his Iter ltalicum. In all of these enterprises he has set an enviable example for other scholars by the exacting standards and the breadth of his expertise. It is only fitting, then, that the many essays in this Festschrift should reflect the breadth and depth of the scholarship so evident in the man to whom they are dedicated. As God, the Son is omniscient, immutable, all-powerful, etc., but in his new mode of existence as man, he is truly ignorant, passible, and limited. Existing as man, the Son experiences all that pertains to historioolly conditioned humanity. In the Incarnation the (...) "·who", the person, remains the same, but the manner of the experience of the " Who " is distinctly different-divine and human-without confusion, change, division, or separation. The mystery obviously remains, but it is meaningful and coherent. As stated at the outset, Morris presents a thorough and provocative study which should be read and studied by scholars. While he aptly critiques his opponents, he fails to challenge their understanding of the incarnational notion of "become" and the ensuing union. Rather, he himself presupposes that the Incarnation implies a compositional union of natures which in turn leads to an unresolvable incompatibility between the divine and human attributes in Christ. Morris may have been aided had he been more acquainted with the early Christological controversies and councils. Nevertheless, Morris has clearly raised many important contemporary Christological issues and has admirably attempted to provide answers which are faithful both to the Christian tradition and to human i~ea..'\On and logic. In recent years the pathology of atomistic individualism has been variously described by the Council Fathers of Vahlcan II, liberationist and feminist theologians, Stanley Hauer.was, and countless other theological and secular critics. According to Frank Kirkpatrick, therapeutic intervention will not be effective in the long run unless it is based upon an alternative conceptual "model" of human oommunity. Of course, Kirkpa.tric.k has something specific in mind. Not just any alternative will do. Marxian models of human association, for example, are prone to BOOK REVIEWS 373 totalitarianism and the denial of proper individuality. Thus, he offers what he calls "the mutual/personal model of community" as "a substantial grounding for a Christian vision of community congruent with liberationist and feminist concerns " (vii). Western culture has generated a welter of perspectives on the nature and ground of human association. Within this motley, Kirkpatrick discerns three models of oommunity which have shaped Western social philosophy and religious thought. The book de~crihes these traditional models by identifying their controlling metaphors, accounts of human nature and its fulfillment, and the social, economic, and political practices and institutions they undergird. The author appraises the strengths and weaknesses of the models and attempts to reconcile their positive features within the Christian vision of Koinonia. The first model is "the atomistic/contractarian" wherein persons are regarded as "independent atoms rationally contracting with each other for the terms of their enforced relationship" (2). Kirkpatrick locates its sources in the thought of Hobbes, Locke, Bentham, James Mill, Adam Smith, and Rousseau. Observing that the individualism of this tradition has always flourished in America, Kirkpatrick surveys some of its c001temporary expressions in the work of George Gilder, F. A. Hayek, Michael N·ovak, Robert Nozick, and John Rawls. The fruits of the atomistic/ contracta.rian model are, to Kirkpatrick's taste, mostly bad-isolation, alienation, oppression, injustice-and are ineongruent with Christian Koinonia. His second model, " the organic/functional," views persons as "organs, interdependent and functionally related to each other within a larger organism" (2). Conceived by Edmund Burke, this model became fully formed and viable in the thought of Hegel and Marx, and was instrumental in the analyses of sociologists such as Ferdinand Tonnies and Charles H. Cooley. Kirkpatrick is troubled by this model's tendency to view human relationships exhaustively in terms of co-operativ.e function. The majority of traditional students enrolled at most colleges and universities are a part of what has been termed the Millennial Generation, also known as Generation Y, which typically describes the group of individuals born in most of the 1980s and 1990s. This cohort’s life has been shaped by corporate scandals, economic instability, and worldwide tragedies. Concurrently, business ethics has become a popular topic in the news within the last 2 decades due to the increase in the number of high-profile (...) business scandals. Unfortunately, this trend has also been accompanied by an increased number of reported incidents of academic dishonesty at many major universities. Two underresearched factors that may be related to academic dishonesty and cheating behavior are religiosity and spirituality. This article attempts to shed more light on the relationship between religious beliefs and unethical behavior, with a focus on millennial college students. It is posited that religiosity and spirituality influence an individual’s attitudes, views, decisions, and ultimately behaviors. The results of this study indicate that religiosity but not spirituality is a predictor of students’ attitudes toward cheating and cheating behavior. (shrink)

In describing the flawless regularity of developmental processes and the correlation between changes at certain genetic loci and changes in morphology, biologists frequently employ two metaphors: that genes ‘control’ development, and that genomes embody ‘programs’ for development. Although these metaphors have an admirable sharpness and punch, they lead, when taken literally, to highly distorted pictures of developmental processes. A more balanced, and useful, view of the role of genes in development is that they act as suppliers of the material needs (...) of development and, in some instances, as context‐dependent catalysts of cellular changes, rather than as ‘controllers’ of developmental progress and direction. The consequences of adopting this alternative view of development are discussed. (shrink)

Purpose: Understanding the place of Ernst von Glasersfeld's Radical Constructivism (RC), and some of its implications, in the development of epistemology. Design: Characterization of two main options for the content of "knowledge" (without and with belief in mind-independent structures), sketch of their history in occidental thought; comparison of their properties concerning subjectivity, objectivity, second-order cybernetics, reliability of mental tools, and the needs and mechanisms for certainty and overall structures. Findings: Awareness that we structure mental working tools can, as RC suggests, (...) replace belief in mind-independent reality, and this change dissolves the conceptual problem of metaphysics-ontology, but also eliminates the certainty expected from it, which raises the possibility of relativism. Working-concepts cannot be deconstructed because they imply no ontological claims. Subject(s) are necessarily included in all knowledge (which does not mean solipsism): because subjective experience encompasses all mental tools, including those of objectivity and mathematics, while in contrast the subject itself cannot become an objective system. Practical reliability of mental tools differs from subjective certainty, which requires an ontological leap of faith to positive beliefs: for specific tools including automata, and for positive holistic structures. However, in agreement with the constructivist view, holistic views can instead have an unstructured center, with reliability = viability, which prevents relativism. In sum, belief in mid-independent reality is needed for certainty if desired; for all other purposes constructivism is more helpful. Implications: The change in view suggested by von Glasersfeld's work is of relevance for a number of fields of study with conceptual problems (such as the mind-brain relation). However, due to their generality, the implications will need evaluation in specific instances. The question of certainty needs attention for practical reasons. (shrink)

This book is intended for the use of the candid student, devised as a monitory preparation for deeper study of the philosophy of Spinoza. By its means it is hoped that the student may avoid the chief pitfalls of Spinoza-interpretation, and be carried past many of the difficulties encountered by the modern mind in the study of his writings. To this end perhaps the greatest hindrance to be met by the beginner is the ‘popular' exposition that attempts to expound the (...) thought of one age in terms of the favoured categories of another. By providing the necessary safeguards against misinterpretations arising from such causes, the author has sought to awaken interest in the closely knit fabric of Spinoza's doctrine of man and nature and God, and its practical import - and thus to revivify a specimen too long deprived of its native air. Purpose: To show that the mind--brain relation can be understood from a perspective that keeps the mind at the center. Problem: Since at least the time of Augustine, the puzzle of the mind--brain relation has been how the mind is attached to, or originates from, the body or brain. This is still the prevalent scientific question. It implies assumption of a primary (ontological) subject--object split, and furthermore that subjective experience can be derived from, or even reduced to, a fictitious mind-independently (...) pre-structured reality. This belief in mind-independent reality is closely related to the development and use of language. It in turn means that the mind cannot be real because it cannot be mind-independent and so disappears from discussion, preventing access to the mind--brain question. Solution: The problem requires an epistemology which keeps subjective experience at the center but does not interfere with objective methods. The un-testable proposition of mind-independent structures can be re-formulated as the use of templates for thinking: a method created by humans, a knowable tool, that is, "working" or "as-if" ontology-metaphysics. Truth and reality, including the reality of objective brain activity, then become working tools within ongoing subject-inclusive encompassing experience. Conclusion: The traditional mind--brain puzzle is the result of erroneous premises, and can be replaced by the question: how does working-objective knowledge originate within encompassing experience? This is a novel and contradiction-free approach to studies of the mind--brain relation and related questions. (shrink)
